White House Is Actively Reconsidering Trump’s NEPA Rulemaking

Bloomberg Law reports, the Biden administration has “numerous concerns” about controversial revisions of the federal regulations on National Environmental Policy Act enforcement implemented by the Trump administration in 2020. The While House went to court this week seeking remand of a case challenging the revisions so that current environmental officials can complete their “comprehensive reconsideration” of the 2020 rulemaking. The review process could result in the issuance of amendments or an outright repeal, a Biden official said. The article notes, “ClearView Energy Partners, a research firm, warned that the rule’s uncertain status ‘is likely to pose challenges’ for projects under review. . . .”
