USDOT Submits Proposed New DBE Regulations For Public Comment

USDOT has introduced proposed new rules for implementing Disadvantaged Business Enterprise (DBE) and Airport Concession DBE programs. According to a news release, “By modernizing the existing regulations, the [proposed rulemaking] would help further level the playing field for small, disadvantaged businesses seeking to compete for federally assisted aviation, highway, and transit contracts as well as airport concession opportunities.” Among other things, the new regulations would update personal net worth and program size thresholds for inflation; modernize rules for counting of material suppliers; incorporate “procedural flexibilities” adopted during the pandemic; “add new program elements to foster greater usage of DBEs and ACDBEs with concurrent, proactive monitoring and oversight;” update certification provisions; and make technical corrections to prevent substantive rule misinterpretations. Public comments should be filed by September 19, although late submissions “will be considered to the extent practicable.”

Atlas Arteria Is Talking With IFM, But Says It's Had No Formal Takeover Offer

The Australian Financial Review reports, Atlas Arteria confirmed today that it has held two meetings with IFM Investors following IFM’s raid on Atlas shares in early June. Atlas management also said it has not received a formal takeover bid. So far, Atlas is still resisting IFM’s request for access to non-public financial information that IFM says could help it decide whether to proceed with a full takeover. For its part, “Atlas Arteria has tried to break down the details of IFM’s stake in the company and said it had sought ‘clarity’ on the complicated arrangements, which include equity options and swaps. . . .”
