CFX's Authority To Grant A Rail Line Right-Of-Way Is Legally Challenged

Orlando Business Journal reports, a residents’ group claims that the Central Florida Expressway Authority (CFX) cannot legally grant a right-of-way lease to the company proposing to build a high-speed rail line from Orlando to Tampa. An attorney representing the group maintains that such a lease would violate a 1991 consent agreement, an argument that CFX’s general counsel disputes. Brightline, the rail project developer, has been in negotiation with CFX and FDOT for months over rights-of-way that would permit it to build segments of the line adjacent to exiting highways, including SR 417.
