Washington Court Upholds Verdict Favorable To WSDOT In Tunnel Lawsuit

The Seattle Times reports, Washington State DOT has won another round in a legal dispute with Seattle Tunnel Partners (STP) over SR 99 Tunnel construction. A state appellate court recently upheld a jury award of $57 million to the department for costs related to building delays. The same jury found that STP was not entitled to $300 million in delay damages it sought from WSDOT. At issue in the jury trial was the cause of a breakdown in the massive boring machine nicknamed “Bertha” that added years to the original project schedule. (STP was a joint venture formed by Dragados USA, part of Grupo ACS, and Tutor Perini.)
